1. Who we are and agreeing to these terms

This website, orkestr8er.com (the “site”), is run by Fern Drip Creative Studios LLC, doing business as Orkestr8er (“Orkestr8er”, “we”, “us”). By using the site, you agree to these terms. If you don't agree, please don't use the site.

2. Information on the site is general

Everything on the site, including descriptions of services, examples, checklists, explainers and demos, is general information to help you understand what we do and whether we might be a fit.

• No guaranteed results. When we describe outcomes (like time saved or fewer missed inquiries), those are goals or examples, not guarantees. Results depend on your business, your tools, your team and many other things.
• Not professional advice. Nothing on the site is legal, tax, accounting, financial, security or compliance advice. For those, talk to a qualified professional.
• Things change. We may update, change or remove services, content or features at any time. We try to keep information accurate, but don't promise it's always complete or current.

3. Demos and examples

Demos, sample installs and diagrams on the site are illustrations. They're labeled as demos or examples. They aren't real client projects or results unless we clearly say so, and we only publish real client stories with the client's permission.

4. Services and pricing

The site describes our services in general terms. Scope, timing, price, ownership, support and every other detail of paid work are set out in a written proposal or agreement for each project. Nothing on the site is an offer you can accept to form a contract. Prices aren't listed publicly and are discussed directly.

5. Contact form and communications

• Please give accurate information, and only information you're allowed to share.
• Don't send passwords, login details, payment or bank information, government ID numbers, health information, or your customers' private records.
• Sending an inquiry doesn't create a client relationship or any obligation on either side.
• You'll get an automatic confirmation email, and we aim to reply within 1 business day (Hawaii time). That's a goal, not a guarantee.
• How we handle your information is explained in our privacy policy.

6. Acceptable use

Please don't:

• use the site for anything illegal, or to harm, harass or impersonate anyone;
• send spam, automated or bulk submissions, or misleading inquiries through the form;
• try to break, overload, probe or get around the site's security, or get unauthorized access to any system;
• scrape or copy the site's content in bulk, or use it to train AI models, without our written permission;
• upload or send malware or other harmful code.

We may block access or ignore submissions that break these rules.

7. Our content and brand

The site's text, design, graphics, diagrams, animations and code belong to us or our licensors, and are protected by intellectual property laws. The Orkestr8er name and logo are our brand.

You're welcome to view the site, share links to it, and use resources we offer for download (like checklists) in your own business. You may not copy, resell or republish our content or code, or use our brand in a way that suggests we endorse you, without written permission.

8. Third-party links and tools

The site may link to or mention other websites and software (for example, tools we connect for clients). We don't control them and aren't responsible for their content, terms or privacy practices. Mentioning a tool isn't an endorsement by that company or a partnership with it, unless we say so.

9. Disclaimer

The site is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, about the site, including that it will always be available, error-free, secure or fit for a particular purpose. This doesn't limit any promises we make in a separate written agreement for paid work.

10. Limitation of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of, or inability to use, the site. Our total liability for any claim related to the site is limited to US $100. Some places don't allow these limits, so they may not apply to you. Nothing here limits liability that can't legally be limited.

11. Indemnity

If you misuse the site or break these terms, and that causes a claim against us, you agree to cover the reasonable costs of that claim, to the extent the law allows.

12. Governing law and disputes

These terms are governed by the laws of the State of Hawaiʻi and applicable US federal law. Before filing any claim, we both agree to try to resolve the issue informally, by contacting the other in writing and allowing 30 days to work it out. If that doesn't work, any dispute will be handled in the state or federal courts located in Hawaiʻi.

13. Changes to these terms

We may update these terms from time to time. The date at the top shows the current version. Continuing to use the site after a change means you accept the updated terms.

14. General

If any part of these terms is found unenforceable, the rest still applies. If we don't enforce something right away, we haven't given up the right to enforce it later. These terms, together with the privacy policy, are the full agreement about use of the site. Paid work is covered by its own agreement.
